Terms of Service

By completing your purchase and/or checking the acceptance box during checkout, you agree to the following terms and conditions.

EQUIPMENT RESPONSIBILITY

Customer is responsible for all rented totes and equipment from the time of delivery until pickup is completed by Metro Totes To Go. All items must be returned in the same condition as delivered, normal wear and tear excepted. Normal wear and tear does not include cracks, broken lids, missing components, excessive staining, permanent markings, misuse, or damage caused by improper handling.

DAMAGE OR LOSS

Replacement costs:

• Tote (bin + lid): $10 each

• Tote Dolly: $40 each

• Hand Truck: $150 each

Smoke odor, heavy contamination, or damage requiring replacement is subject to replacement fee.

Customer authorizes Metro Totes To Go to charge the payment method used during checkout for any damage, loss, replacement costs, cleaning fees, late fees, collection costs, or other amounts due under this Agreement.

LATE RETURNS

20 Tote Package: $40 per additional week or $7 per additional day.

40 Tote Package: $60 per additional week or $9 per additional day.

60 Tote Package: $80 per additional week or $12 per additional day.

Hand Truck: $40 per additional week or $6 per additional day for standalone rental; $20 per additional week or $3 per additional day when rented with a tote package.

PICKUP ACCESS

All totes and equipment must be empty, accessible, and ready for pickup at the scheduled time in the agreed-upon accessible location (such as a garage, porch, or driveway). Additional fees may apply if pickup cannot be completed as scheduled.

PROPER USE

Totes and equipment may not be used for hazardous materials, liquids without proper sealing, illegal materials, or materials likely to damage equipment. Customer is responsible for damage caused by misuse.

LIABILITY WAIVER

Customer assumes all risks associated with the use, handling, transportation, storage, and possession of the rented equipment. To the maximum extent permitted by Illinois law, Metro Totes To Go shall not be liable for any injury, property damage, loss, claim, expense, indirect damages, consequential damages, or other damages arising from the use, misuse, transportation, storage, or possession of the rented equipment, except to the extent caused by Metro Totes To Go’s gross negligence or willful misconduct.

INDEMNIFICATION

Customer agrees to indemnify, defend, and hold harmless Metro Totes To Go, its owners, employees, contractors, and affiliates from and against any claims, liabilities, damages, costs, expenses, and attorneys’ fees arising out of or related to Customer’s use or misuse of the rented equipment.

CONDITION ACKNOWLEDGMENT

All equipment is delivered clean and in usable condition. Customer accepts the equipment as delivered unless a condition issue is reported within 24 hours of delivery.

CHANGES / EXTENSIONS

Extensions are subject to availability and additional charges.

NON-RETURN & REPLACEMENT CHARGES

If equipment is not returned within 30 days of delivery and no extension has been arranged, the equipment will be considered unreturned. Metro Totes To Go may charge replacement costs to the payment method on file.

FORCE MAJEURE

Metro Totes To Go shall not be responsible for delays or failure to perform services caused by events beyond its reasonable control, including weather, natural disasters, traffic conditions, vehicle failures, labor disputes, utility outages, or governmental actions.

LIMITATION OF DAMAGES

In no event shall Metro Totes To Go’s liability exceed the amount paid by Customer for the rental transaction giving rise to the claim.

COLLECTION COSTS

Customer agrees to pay all reasonable costs of collection, including attorneys’ fees, court costs, and collection agency fees, incurred by Metro Totes To Go in enforcing this Agreement or recovering unpaid amounts.

GOVERNING LAW AND VENUE

This Agreement shall be governed by the laws of the State of Illinois. Any dispute arising from or relating to this Agreement shall be brought exclusively in the state or federal courts located in Illinois.

ELECTRONIC ACCEPTANCE

By checking the acceptance box during checkout, Customer acknowledges that they have read, understood, and agree to be legally bound by this Agreement. Electronic acceptance shall have the same force and effect as a handwritten signature under applicable law.
